Terms of Service

1. The Platform and the Parties

Move-Me is a technology platform operated by Inka-Tech Solutions (Pty) Ltd ("Company", "we", "us") that connects individuals who need transport services ("Senders") with independent bakkie owners and operators ("Drivers"). The Company is not a transport provider. We provide the technology that enables Senders and Drivers to connect, transact, and communicate.

Drivers are independent contractors, not employees or agents of Inka-Tech Solutions. The Company is not responsible for the acts or omissions of Drivers.

2. Eligibility

• You must be at least 18 years old to use Move-Me.
• You must be a resident of or operating within the Republic of South Africa.
• You must provide accurate, truthful information during registration and identity verification.
• You must have a valid South African ID or passport.
• Drivers must hold a valid South African driver's licence for the class of vehicle operated.

3. Identity Verification (KYC)

Move-Me operates a mandatory identity verification process for all users:

Senders must submit a selfie and South African ID number before posting any job. This information is stored securely and may be used to identify parties in the event of a dispute, scam, theft, or criminal activity.

Drivers must submit a selfie, SA ID document, driver's licence, vehicle licence disc, number plate photo, registration number, and 4-angle vehicle photographs. Drivers may only operate on the platform once manually approved by the Move-Me admin team.

4. Platform Fee and Payments

• Posting a job is free.
• A platform fee of R10.00 is charged when a Sender accepts a Driver's offer, and when a Driver submits an offer. This fee is non-refundable once paid.
• The Driver's service fee is agreed between the Sender and Driver. Move-Me does not set or guarantee Driver prices.
• All payments are processed securely through PayFast. Move-Me does not store your card details.
• Refunds for the platform fee are at the sole discretion of Inka-Tech Solutions and are only considered in the case of verified platform errors.

5. User Conduct

All users agree not to:

• Provide false identity information or impersonate another person
• Use the platform to transport illegal goods, contraband, or stolen property
• Use the platform to facilitate crime, fraud, theft, or scams
• Harass, threaten, or abuse other users
• Circumvent the platform's payment system by transacting off-platform
• Post jobs for goods or services prohibited by South African law
• Create multiple accounts to circumvent bans or verification requirements
• Reverse-engineer, scrape, or otherwise misuse the platform

Violation of these rules may result in immediate account termination and, where applicable, referral to law enforcement.

6. Driver Obligations

• Drivers must hold a valid driver's licence for the class of vehicle used at all times.
• Drivers must ensure their vehicle is roadworthy, licensed, and insured.
• Drivers must complete jobs they have accepted, except where safety concerns arise.
• Drivers are responsible for any damage caused to a Sender's goods through negligence, recklessness, or wilful misconduct.
• Drivers must not transport additional passengers without the Sender's consent.
• Drivers must maintain their verification documents and notify Move-Me of any licence suspension or revocation.

7. Sender Obligations

• Senders must accurately describe the goods to be transported.
• Senders must not request transport of illegal, hazardous, or prohibited items.
• Senders must ensure someone is available at both pickup and dropoff locations at the agreed time.
• Senders are responsible for properly packaging goods for transport.
• Senders must pay the agreed Driver fee as committed in the app.

8. Liability and Indemnification

Inka-Tech Solutions provides a technology platform only. To the maximum extent permitted by South African law:

• We are not liable for loss of or damage to goods during transport.
• We are not liable for the conduct, actions, or omissions of any Driver or Sender.
• We are not liable for any personal injury or property damage arising from a Move-Me trip.
• We are not liable for delays, cancellations, or failure to complete a job.
• Our total liability to any user for any claim shall not exceed the platform fee paid for the transaction giving rise to the claim.

You agree to indemnify and hold harmless Inka-Tech Solutions, its directors, employees, and agents from any claims, losses, damages, or expenses arising from your use of the platform or violation of these Terms.

9. Dispute Resolution

In the event of a dispute between a Sender and Driver:

• Report the issue through the in-app reporting feature or by emailing support@moveme.app.
• Move-Me may facilitate communication between parties but is not obliged to resolve disputes.
• Where criminal activity is suspected (theft, assault, fraud), users are encouraged to report directly to the SAPS. Move-Me will cooperate fully with law enforcement, including providing identity verification information of users involved.

10. Account Suspension and Termination

Move-Me reserves the right to suspend or permanently terminate any account at any time for:

• Violation of these Terms
• Fraudulent, illegal, or abusive behaviour
• Providing false identity information
• Receiving repeated low ratings or verified complaints
• Non-payment of platform fees
• Any reason we deem necessary to protect users or the platform

11. Intellectual Property

All content, branding, code, design, and materials on Move-Me are the intellectual property of Inka-Tech Solutions (Pty) Ltd. You may not copy, reproduce, distribute, or create derivative works without our written permission.

12. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the South African courts.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via the app. Continued use of Move-Me after changes constitutes acceptance. If you do not agree to the updated Terms, you must stop using the platform and delete your account.
